Clear Truth Privacy Policy
DRAFT FOR ATTORNEY REVIEW - NOT IN FORCE
This policy says what information we collect, why, who sees it, how long we keep it, and how to ask us to delete it. The short version: we collect what we need to review your report and send you the result. We do not sell personal information. We do not use your report in marketing unless you check a separate box saying we may.
1. Who is responsible for your information
[Owner Legal Name], an individual doing business as Clear Truth, Massachusetts. Contact: [Contact Email]. Mail: [Business Mailing Address].
2. What we collect
Your inspection report. The file you upload. A report usually contains the property address, the inspector's and inspection company's names, photographs of the property, the inspector's findings, and often your name. It may contain information about other people, such as the seller, occupants, or agents.
Your intake answers (optional). Your closing date, whether you are under contract or already own the house, what you most want to know, and anything the inspector said to you that is not in the report.
Your name and email address. Needed to deliver your Review and to reach you about your order.
Payment information. Payment is handled by Stripe. We receive confirmation of payment, the amount, the card brand and last four digits, the billing name, and [the billing postal code]. We never receive or store your full card number or security code. Stripe's privacy policy covers what Stripe collects.
Messages you send us. Email and any support messages.
Website analytics and server logs. IP address, browser and device type, pages visited, the page you came from, approximate location derived from IP address, and timestamps. Analytics are provided by [Analytics Provider]. Hosting and logs are provided by [Hosting Provider, planned: Cloudflare].
Newsletter sign-up (only if you choose it). Your email address.
What we do not want. Please do not send us Social Security numbers, dates of birth, government ID numbers, or bank or card numbers. We do not ask for them and do not need them. If your report contains information like that, remove it before uploading. If we notice it, we remove it from our working copy.
3. How we use your information
- To produce and deliver your Review.
- To communicate with you about your order, including corrections and refunds.
- To process payment, prevent fraud, and handle disputes or chargebacks.
- To keep our records, meet legal and tax obligations, and protect our rights.
- To improve how we review reports. We may study what we learn from reviews in a form that no longer identifies you, the property, or the inspector. [Counsel to confirm this use is appropriate without a separate opt-in.]
- To send you our newsletter, only if you sign up for it. Every newsletter has an unsubscribe link.
- To use anonymized excerpts in marketing, only if you check the separate marketing box. See Section 6.
We do not use your information for anything else.
4. How your report is processed
We use software to extract the text and images from your report. We use artificial intelligence tools provided by [AI Service Provider] to help read the report and prepare the Review, and we check the result against your report before delivery. To do this, the contents of your report are sent to that provider for processing. [Owner and counsel to confirm the provider's terms and state them here plainly: whether the provider may use your content to train its models (our intent is that it may not), and how long the provider retains it.]
5. Who we share your information with
Service providers who work for us. Hosting [Hosting Provider, planned: Cloudflare], payment processing (Stripe), file storage [Storage Provider], email delivery [Email Provider], AI processing [AI Service Provider], and analytics [Analytics Provider]. They may use your information only to provide their service to us.
When the law requires it. To comply with a law, court order, or subpoena, or to protect the rights, safety, or property of you, us, or others.
If the business changes hands. To a company we form to run Clear Truth, or to a successor to the business. Your information stays under this policy.
No one else. We do not sell personal information. We do not share it with anyone for their own marketing. We do not share your report or your Review with the inspector, the inspection company, the seller, any agent, or anyone else unless you tell us to in writing.
6. Marketing excerpts: your choice
At checkout there is a separate, optional checkbox that reads, in substance: "Clear Truth may use anonymized excerpts from my inspection report in its marketing." It is unchecked by default. Checking it is not required to buy a Review and does not change the price or the service.
If you check it, we may use short excerpts of the report's text in our marketing. [Decision for owner and counsel: whether photographs from the report may be used; see the attorney brief.] Before any use we remove the property address, your name, the names of the seller, agents, inspector, and inspection company, report numbers, logos, and identifying features in any image (house numbers, street views, faces, vehicles, license plates). We never publish the full report, and we never identify the property's location beyond its state or region.
You can withdraw this permission at any time by emailing [Contact Email]. We will stop any new use within [10 business days] and remove the excerpt from marketing we control. Material already distributed, such as printed pieces or posts on third-party platforms, may remain where we cannot remove it.
7. How long we keep your information
| Information | How long | Why |
|---|---|---|
| Your inspection report and intake answers | [13 months] after we deliver your Review, then deleted from active systems. Backup copies are removed within [30 days] after that. | To correct errors, handle refunds, and respond to any claim during the one-year claim period in the Terms. |
| Your Review and order record (name, email, amount, date, Review) | [7 years] | Tax, accounting, and legal records. |
| Email and support messages | [3 years] | Customer service and disputes. |
| Analytics and server logs | [14 months], or the provider's default if shorter | Site operation and security. |
| Newsletter email address | Until you unsubscribe | You asked for it. |
| Anonymized marketing excerpts (with your permission) | Until you withdraw permission | Marketing. |
If you ask us to delete your information sooner, Section 8 applies.
8. How to ask us to delete, correct, or send you your information
Email [Contact Email] from the address you used to order, or include your order number. You may ask us to:
- delete your report, intake answers, and personal information;
- correct your name or email address;
- send you a copy of the personal information we hold about you; or
- tell you what we have done with it.
We will confirm your identity by matching your email or order number, and we will act within [30 days]. We will delete everything we can. We may keep what the law requires us to keep, such as tax and payment records, and a minimal order record or copy of the Review if needed to handle a dispute, in which case we will tell you what we kept and why.
We offer these choices to everyone, in every state, whether or not a state privacy law requires it. We will not treat you differently for making a request.
9. Security
Your report and your Review travel over encrypted connections (HTTPS). Access to stored files is limited to the people and systems that produce your Review. Review links are long and unguessable, and expire after [90 days]. Card payments are handled by Stripe, which is PCI compliant. No system is perfectly secure, and we cannot promise that one is. If a security incident affects your information, we will notify you as the law requires, including under Massachusetts General Laws Chapter 93H and the law of your state.
10. Cookies
We use as few as possible: a session cookie so the checkout works, cookies set by Stripe during payment for fraud prevention, and [analytics: state whether the provider sets a cookie]. We do not use advertising cookies and do not allow third-party advertising trackers on our site.
11. Children
Clear Truth is for adults. We do not knowingly collect information from anyone under 18. If we learn that we have, we delete it.
12. People named in your report who are not you
Your report may name or picture other people: the seller, occupants, agents, the inspector. We use their information only as part of reviewing your report. We do not contact them, we do not share their information, and we remove identifying details from any excerpt you allow us to publish.
13. Where information is stored, and who may use the service
Your information is stored in the United States by the providers named in Section 5. [Confirm each provider's storage region.] Clear Truth is offered to people in the United States only.
14. Changes to this policy
We may update this policy. We will post the new version with its date. If a change materially affects how we use information we already hold about you, we will email you at the address on your order before the change takes effect.
15. Contact
